Taking car rental company to Ontario smalls claims court for breaching contract - ontario rental forms

I rented a car to indicate qoute, unlimited mileage based. After I returned the car, he said, unlimited mileage, does not apply if the appliance in Ontario. Nobody told me about these limits, and it does not appear in my rental agreement form, which I had signed. Can I sue them for breach of contract. A tip, a person familiar with the Small Claims Court of Ontario is estimated

  1. Hi:

It would depend on the wording in the contract. There may be an "Entire Agreement" clause which can preclude you from relying on anything that was or was not said outside the words of the contract. On the other hand, the small claims court is a court of equity, and even with such a clause, the court may allow you to claim you were misled by a misrepresentation. I cannot imagine we are dealing with a charge of more than a few hundred dollars, and therefore you have to weigh the cost of filing and pursuing a claim ($75 to file, $100 to set down for trial and time away from work for court hearings) with the possibility of settling early or winning at trial. Best of luck.

  2. I have some familiarity with the system of small claims in Ontario. It's pretty simple, but the best thing I can say is at the link below. Links to many great resources, especially that you have to think and do disaster.

Even if nobody told you about the limitation and the lease is silent on this, the important question that remains is what you lose. If a contract is to be debited on your credit card is best for your credit card for unauthorized charges, which can often be very useful and you get to save yourself in court.

I have never seen a car company was limited rather than unlimited mileage. How do you know how many miles in Ontario and how it is not good?

However, assuming that you have told them they took the car out of the province, should the new contract. If you travel from the provinces to say, that the article in the agreement. The agreements are very specific when we say, probably somewhere.

FYI: I always say, future landlords, where you go if you do not get a surprise in the end because some do, in fact, costs for travel outside the province, including the United States. Not all do so, but some.

  5. You can, but you'll get fired.

appropriate, if any, is that you have been overcharged, and you should be refunded the difference.

I rented a car and they have delivered. The debate about the price.

Curiosity, not as they know that the Left in Ontario?
